Hi all looking for some Assistance. My partner bought a car on finance via car finance 247 and collected the vehicle from the dealership at which point she signed the contract. Over the next couple of days we had noticed a damp smell coming from the Vehicle and it wasn't until lifting up the drivers side floor mat we noticed a big hole approximately the size of a fist in the floor! I understand that maybe we should have checked the car more thoroughly, however we had been reassured that the car had been fully valeted and so I feel we have been completely mislead here. What's the deal with handing the vehicle back? We only purchased the car 4 days ago

You are covered by the Consumer Rights Act 2015
You can reject the car in the first 30 days.
Send the following template, send it Recorded Delivery to the dealer and the finance company.

So today we've been having it out with the finance company who have stated that the dealership are under no obligation to take the car back (since we drove away before we noticed the damage)
I haven't yet completed the template letter as advised above but that will be next steps. Meanwhile stuck with a damaged vehicle, at no point was this dislosed to us at any point before sale... feel really gutted .
Would appreciate everyone's thoughts on this.

That is the sort of damage that the dealer would have noticed and should have told you about, but didn't.

In the same letter insert the following paragraph, just below the CRA 2015 paragraph -
The Consumer Protection from Unfair Trading Regulations 2008 protects consumers from unfair or misleading trading practices.

Contact CAB / Trading Standards, tell them about the 'hole', the dealer didn't tell you about it, they will give you some advice, but also a Reference number.

The agreement is a 'non starter' because the 'dealership' knew about the 'hole' (covered it up literally) but didn't tell the OP,
sounds like 'misrepresentation'.

It might be misrepresentation, or anything else, but if OP cancels the direct debit before the rejection is accepted he will be breaking his finance agreement.
Suppose rejection is not accepted and matter goes to court eventually and OP loses (we don't know full background eg price paid age & mileage etc etc and we have seen cases lost!).
If DD was cancelled the OP's credit record could be impinged
I certainly would not be cancelling any DD, but it is up to OP to decide

Hi all , so the dealership are refusing to take the vehicle back but they are willing to replace the carpet. Problem I have is that if they have lied about the whole then what else is wrong with it? The car absolutely stinks or mould at thus point and my partner and daughter both have asthma so I cannot risk them getting in it anyway. Am I in my rights to pursue with the rejection..... its causing so much stress!
