  • Hoist Finance Letter

    Good morning All,
    Thank you for all the previous help and I have finally built up my credit scores and finalised all my debts over the past 3 years. However I have recently received a letter from Hoist Finance which again has made me feel sick to my stomach.

    I have contacted them today on their live chat section without registering but have confirmed my identity online. They have advised me I have an outstanding balance of £2880.02 with Santander. I have no recollection of this but by all accounts in the past I have noted a dispute on the account via telephone to which I honestly cannot recollect due to huge debt I was in. They advised I would have to email for more details as this could not be discussed online.


    So I am now asking how would I obtain all the details of the account in question showing when this account was taken out, Can I request original documentation? plus dates of how old this is from ?. Any advise as always would be fantastic as I was really beginning to feel free and all oy debt and soaring high with my credit score.

    Try not to stress yourself .

    It might be a 'phishing trip'. Does it appear on your credit file? You could send Santander a SAR request, they have 30 days to provide all the data on the account. Depending on what that shows, you could consider sending a CCA request. Make sure you get Proof of Postage for the SAR.

      CCA Request send with £1,00 postal order, get proof of posting and keep copies on file of all correspondence

        Good afternoon Mike,

        Much appreciated for the reply.

        I cannot see this through Experian and Equifax as I do pay for the premium accounts. There is nothing Showing here?
        So I can fill in the link for the letter template and send this to them in letter format and obtain proof of postage and delivery signed for ?

        Would this be with Santander or Hoist finance if they have supposedly bought the debt? Also will I have to send over a copy of the original letter from Hoist also?

              Hi All, Just a quick update on this as all the information has now been collated and looked at. This was an old debt to which I was given a Judgement / CCJ on 26/5/2015 ( While I was in the middle of having to close my business and sell my home). Hoist Finance has now sent me all the dates/information requested as mentioned above. This debt is no longer on my credit file and they have written and emailed stating my account is now on hold. Surely after the CCJ was served and now cleared after 6 years from my credit history. Is this still an active debt and is now removed from then poor credit or can this now be ignored as time has elapsed past the 6 years?

                CCJ never runs out -( But they may be short of monies and hope people are unaware of procedure) (but if no action by them within 6 years would need a very good excuse to resurrect it to a court) many are trying old ones as they are hoping to cash in without a fight? maybe. Celestine may be able to comment?

                  Unfortunately the ability to enforce a CCJ never technically runs out. If they attempt to enforce, they would need to seek the courts permission and would have to explain the excessive delay. However, courts tend to grant such applications unless vigorously opposed.

                      Did you send a Subject Access Request for all the data on the account?

                      You need make sure they followed all the protocols in order to obtain the CCJ. The information on your account would help in answering that question.

                        Hello Sorry for the delay, Yes I did request the SAR after Hoist emailed me. They have since emailed all the information to me with a note below at the end of the email. I have checked my reports and this was a CCJ which has now passed.
