  • N1SDT court claim form

    Hi
i was hoping i could get some advice.
I have been foolish and this has what has got me to this point
In June 2020 i was given a parking charge by UK Car Park Management Ltd. I had popped into the shop as was feeling unwell. I wrote to appeal and it was rejected. I read a little online and came to the conclusion these companies are all scam artists so i ignored it. I got a Letter before Claim on 16.07.21 which i ignored.
A court form has now arrived dated 8.9.21. (N1SDT).
I recognise i have been extremely foolish to just ignore this and hope it would go away. Lesson learnt! i have spend hours reading through threads to get advice.
I feel silly to contest this as it was purely down to my own ignorance. The cost will be £270.22.
    My questions are:
-If i chose to pay to i haveto disclose all this confidential information on the forms about my income etc
-if i chose to contest part of it then would i still end up in court.
I suffer from anxiety and the thought of attending a court petrifies me.
    I would appreciate your advice.

First of all court is not like you see on TV:- 3 people in a room the judge with the bigger desk, you and the claimant.

Acknowledge the claim 5 days after, or shortly after, the date of issue using the details and password on the form. This gives you 33 days from date of issue to get your defence to court

You don't have to disclose your income etc

The cost is over the top. Part of your defence will include this: https://www.dropbox.com/s/16qovzulab...inson.pdf?dl=0 to object to the extra amounts

Post up a copy of the PCN you received or request copies from the solicitor using CPR 31,14 ( look to your right)

SAR to the parking company for all documents the have about you and your car

      Hi CULL43

Try not to worry, yes penalty charges are a 'scam'. But they are an effect way of generating a revenue for various entities.

I dont have the original PCN.
So to clarify: i should log in and acknowledge the claim. Then use the CPR form and request all information to be sent to me.
        What is a SAR?
Is paying it an option i should consider? if i end up paying the full cost anyway then it may not be worth the weeks of stress that will lay ahead.

          d) You won't lose the option to consider making payment

                a) You have 14 days to Acknowledge of Service (which you say you have now done online). Once AoS has been done you get an extra 14 days, which gives you 28 days in total to work out your defence. So the date is 28 days from the date on the claim form. In reality you get 33 days because of postage etc.

The Contract is fine, no need for a sentence.

Did you not read the suggestions for acknowledging in post #3? You now have 28 days to submit your defence

For CPR 31.14 you can only ask for documents mentioned in the Particulars of Claim, the PCN and the signs that created the contract

don't give the date, it will only encourage them to delay responding. You want it within 7 days

                      thanks.
Guess i just worried so thought best to do it online so i can track it .
ill input the date of 6.10.21.
what do you mean by not to send anything off yet? from what i can see it needs sending asap. (would it be recommended to print out and post it as well as sending via email?
I have used the template and added in my details and changed dates. The final section in green about credit agreeement is unclear to me.
I was then going to complete and send the SAR
Am i on the right track? Apologies for all the questions
