    Hi

    just had a letter from a debt collector working on behalf of ingenious law. They are saying i had asked them to work on my behalf to claim PPI. and have an outstanding bill to pay them, although i admit looking into this I never signed anything to persue this.

    i have requested GDPR which they have sent back stating i signed electronically which to my knowledge is false, I have also requested proof of signature and also the contract i supposed to have signed but they have sent nothing, just stating they have emailed several times ant txt.

    please help!!

    Don't panic. Please post up the letter from the debt collector redacting any personal info. If you have trouble posting it up send it to me at nick@legalbeaglesgroup.com and I'll take a look and get back to you tomorrow.

        Hiya

        Silverback are just a solicitors firm chasing the so called debt on behalf of Ingenious Legal, who themselves are solicitors.

        In my view it is extremely unlikely that they would attempt to issue a court claim for just £122 as it would cost them more in time and expenses than the value of the claim. Also as it would qualify as a small claim, solicitors fees aren't claimable by the winning party so it just wouldn't make commercial sense.

        I'm guessing that Ingenious are saying that you signed up with them on some 'free PPI check' website. There were a lot of these in around 2019 which promised to check if you had PPI for free but somehow it morphed into claims management contract which they say people signed digitally.

        Your best option is to make a formal complaint to Ingenious on the basis that you didn't give them your informed consent to make any PPI claims. If they reject the complaint or don't respond to it within 8 weeks you can then take the complaint to the Legal Ombudsman. Once you've made the complaint you should write to both Ingenious and Silverback saying that until such time as the complaints process has run its course it would not be appropriate for them to continue to pursue you for payment. That way you've got them off your back.

        One thing though, the Legal Ombudsman will only accept complaints within 6 months of you receiving a final response from Ingenious or from the point the 8 week period has elapsed from when you first complained. I understand you've challenged Ingenious about it but have they treated it as a complaint and given you a formal final response? Because if they have, the 6 month period that you have to go to the Legal Ombudsman begins from then.

        The Legal Ombudsman is really slow so don't expect them to deal with it anytime soon. Make A Complaint | Legal Ombudsman

          Thank you for the response, I am going to make a formal complaint by Monday this week regarding not giving them consent etc,

            I have recieved a response off ingenious showing me a contract with a signiture on it that is clearly not mine, they are stating that i need to contact action fraud? They are telling me I signed the contract digitally on an apple device.

            i did recieve a cheque from santander for £300 but ingenious carried out this work without my consent.

            help please on what to do next

              You need to tell the LO that you didn't give them your informed consent to make any claims.

                Some good news Legal ombudsman stepped in and stated ingenious legal had no grounds to pursue my case, 2 days later had an email from ingenious saying they had dropped there case against me!
