  • Parking fine

Hello. The driver drove the car and parked in a car park and went to the city centre. The driver returned and purchased some items from one of the shops in the car park and drove out. The keeper was sent a letter on 30/7/2021 by Horizon Parking stating that the vehicle had overstayed the free 2 hour limit by 41 minutes. The letter also showed images and time of the vehicle entering and leaving the car park on 24/7/2021. The letter requested the keeper to pay £85 or £51 if paid within 2 weeks. I would be grateful for any help given. Many thanks.

There is no such thing as a registered driver.

Edit so that the identity of the driver cannot be inferred, the driver drove and parked , the keeper received the letter.

Post up a redacted copy of the PCN that was received. photos of the signs would help.

Hello. I'm unable to see the "edit" icon for my first post, so I was unable to do as you recommended. I have attached a copy of the PCN and will get photos of the car park signs and attach tomorrow. Thanks.

Ithe icon should be on the right of the blue bar at the bottom, you found it in post #3

can't see the PCN. Suggest you put it on a hosting site such as imgur and put a link on here

It's not a fine, it's an invoice for a sum agreed for breach of contract

It's no good putting in the changes later without editing the original. The parking companies have been know to read forums and get the ID of the driver.

There is a link to a photo but no photo appears.

Ask the mods to do the edit on post #1

Shame you didn't leave the dates in!

                    However:

                    Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act nor have you given the invitation to keeper as required by 9 (2) (e) of the same act.

You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

                    Yours etc

First class post with free certificate of posting from a post office

They will probably reject ut POPLA should accept

Hello. I've uploaded the dates you mentioned. But the pictures of the signs were taken today. Does it change anything in the letter you wrote? Also should I send it by first class "signed for" posting in case they deny they did not get a reply from me? Do I also send the same letter to POPLA or wait to get a reply from Horizon Parking? Thanks.

You send it as described in the post with a free certificate of posting. They can refuse signed for.

you can't appeal to POPLA until they reject and give an appeal code

Hello Ostell. I mailed the letter first class and received a certificate of posting. I will update you when I receive a reply. Your help is much appreciated. Thank you very much.
