Failing to provide information relating to the identification of a driver

All that information needs to go in your letter to the CPS (wrong info from police etc) but add that you wish to be a witness and will state the facts under oath. If you call the driver and he does not attend that is not your problem. If he attends and lies he commits purjury and can go to prison. Is there anyone else in your company who would swear under oath that the van was hired out?

I'm not sure there is. The main thing that we are trying to do is get this thrown out without a trial as our customer has lied that it wasn't him and this is the only reason this is happening. We can prove that he lied because the car was still in Watford minutes away from his house multiple times on the 29th. There's no other reason the car would be there if it wasn't in his possession still. He returned the car for us in the evening on the 29th to Luton. Our manager said this was done because he was able to get a lift home from Luton but not from Northampton. Because this is a year old we are unable to get anymore tracker screenshots. You said that the tracker screenshots are not enough proof but this is what the police requested from us which is why we sent them. We sent the first lot to prove he had the car when we were told that he said he had never driven it. They then requested we send screenshots from the 29th so it seems that the screenshots were enough for the police but we just missed the ones for the fine date off. They then sent it to court because our final screenshots weren't received until after they'd sent it to court. It seems like our screenshots were enough but they were just received late. On this basis can we not get this trial cancelled and let the police pursue the driver for the speeding fine?

You can try. Set it all out in writing and send it in - I really hope they decide not to go to trial.

The missing hire contract would help your case at the moment you are calling the Driver a liar and he denies being in the car you really need the contract as i stated before it should be available unless there was never an agrement the court will decide the truth right or wrong
