    Hi All,

    Hope someone can help me.

    I received a window screen ticket for a missing ticket from dash, but have proof of purchase and the bank debit on a screenshot to prove I paid the tariff.

    I am not the keeper of the vehicle it is a lease car from my company, but I have not yet passed the date for payment so no legal letter has been issued to the hire company.

    I cannot find the landowner to appeal to them.

    The ticket was issued 12th September, but I have been struggling to find the right format to appeal.

    The ticket I received is attached for reference, it was from Premier Parking Ltd, an IPC member.

    Edit your post so that the identity of the driver cannot be inferred, use "the driver ......" etc. It's important they do not obtain the identity of the driver at the time.

    I would suggest that you wait till you get a Notice to Hirer from the parking company. Almost without exception they fail to send the required documentation of a copy of the lease and the original NTK to the lease company. They cannot hold the hirer liable under POFA.

    Alternatively appeal as the hirer who has been handed the PCN by the driver. Your appeal is, of course, that the fee was paid and here is the ticket. Send so that it arrives on day 26, 2 days before they can contact the DVLA for the registered keeper details. See if the send a notice to hirer as above or contact the DVLA and then revert to the above process.

      Thank you so much for the clear instruction, I just have a couple more more questions.

      1. From speaking to the lease company, they ave confirmed they automatically pay all parking fines and re-charge my company, so I don't think I can wait until they issue a Notice to Hirer?

      2. Their appeals process says I must appeal within 21 days of the day after the PCN, but your advice is 26 days after. Will I not automatically forfeit my right to appeal by waiting until day 26?

        What did you ask the lease company? Did you ask about fines or private parking charges

        What you have is not a parking fine it as an alleged breach of contract and if the lease company pay it they are acting outside their contract. Their action for private parking charges is clearly set out in POFA and usually on the Notice to Keeper in that they supply hirer details to the parking company and remove liability from themselves. By paying it they are removing your opportunity to appeal

        OK appeal as the hirer so that it arrives on day 21.

        The reason for delaying as long as possible is to get closer to the 56 days they have to issue a notice to Keeper.

        have a good look at that hire contract and see if it gives charges for handling private parking charges.

          Thank you so much Ostell, I am so grateful for your advice thus far.

          Please see below amended appeal, which I will send on day 21. This is a Saturday, so I thought it might be best to send it at 17.30 on the Friday or should I send it on the actual day. The ticket says 21 days after the day on which the ticket was issued and the ticket was issued on 12th September.

          Do I add my contact details at the bottom and am I referring to myself as the lessee, hirer or keeper?

          Based on your advice I am also going to contact the lease company and tell them this is not a parking fine - its a charge and as such they shouldn't automatically pay it as per policy and should contact me if any correspondence is received relating to this charge.


          I have recently received the above numbered parking charge from the driver of the vehicle and dispute your 'parking charge'. I deny any liability or contractual agreement due to the attached evidence that shows that the parking fee was paid for the period up until 16.06 and the Parking Charge was issued at 15.24.

          There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as the images of the vehicle which have already been provided.


          In order to resolve the dispute I attach copies of the parking ticket purchased along with a screenshot from the drivers bank statement to prove the payment for parking was made.

            "I am the hirer of vehicle VRM xxxxx and have been passed your PCN xxxxx by the driver at the time........ The driver disputes any liability....."


            Tell the lease company to comply with the requirements of POFA in order remove any liability from themselves and mitigate any loss.

              Brilliant - do I include my name and address given that they state they wont consider any appeals without this?

              Lastly - Shall I update the thread with the outcome, so others can learn from the excellent advice you have given me?
