  • Probate/Inheritance

    Hello!
I hope you can help. I am waiting on inheritance from an elderly relative. A family member/executor of her will has dealt with her estate rather than a solicitor.
All relevant forms have been submitted and inheritance tax has been paid. He has received an email from HMRC stating they agree with his calculations and there are no more taxes to be paid.
My question is, what happens now? Does he need to send this form to a probate office for it to be granted or is this done automatically by the tax office?
Does anyone have an idea how long it is likely to be for funds to be distributed from this stage. I am looking to move house but ideally need this money to do so yet all I see is 6-9 months but I am not sure if this applies as inheritance has been paid and HMRC agree with figures.
    Thank you in advance.

HMRC will send the stamped IHT form direct to the probate office, I take it he has applied for Grant of probate, sent the will off etc. ? If he has, it should only take a couple of weeks for probate to be granted once they receive the stamped IHT421. I believe an executor has a year to distribute an estate, I suppose it depends on whether property needs to be sold to realise your inheritance or whether there is enough cash, plus the exact wording on the will.

A sensible executor will not distribute the assets until after the expiration of 6 months from grant of probate.
This is because people can make a claim under the Inheritance (Provision for Family and Dependants) Act 1975 up to 6 months after the grant of probate
