    #1 NDR liability orders

    Yesterday, 09:46:AM
council obtained liability orders for alleged debt having followed the procedures. Property occupied by another person under a commercial lease. Council failed to advise it had obtained a liability order, therefore Time bared for a judicial review (case stated) or other remedy except a point of law. In this case the council issued fresh amended rate bills for the liability periods 4 weeks later having obtained liability orders. Has anyone come across this, as in my view a fresh amended bill sets in process the recovery criterion again and arguably cancels the original orders. Does anyone know of any legal authority on this if there is any. The above appears to be the case under the enforcement regulations*

    Cheers.*

Are the demand notices that have been issued simply copies, amended notices or a new liability entirely ?

To have issued completely new demand notices then there would need to have been an adjustment to the original period of liability - the liability orders would only be in respect of that earlier period, they would not be in respect of the new period of liability that has been created.

All domestic rates enforcement is under the Non-Domestic Rating (Collection and Enforcement) (Local Lists) Regulations 1989, as amended.
