  • Banning and pictures for retail shops

    I was banned from primark and the shopping centre that it is. The shopping centre gave me a letter stating how long the ban was from and that my photo would be in there system till ban was lifted but all primark done was took my name address for the fine they said I will get and verbally told me I was banned for an amount of time so does it count if it’s verbal and no picture as surely it’s data protection if I’ve not signed or been given a letter specially if they use an image of me from cctv *

    It sounds like they gave you a standard letter - is it from BCRP ?

    Primark can't fine you, only the police can, what Primark can do is get a third party company to send you an invoice for their alleged costs of dealing with the 'offence'.

        Amethyst*attach letter from shopping centre but that’s all I got and from primark it was all verbal no letter or anything stating how long all that I wrote was my name and address for fine but they got all the stuff back in original state no damage etc

          They usually do get the stuff back in original condition so in reality have no loss, and no costs attributable directly to you... but you'll likely still get a speculative invoice from RLP ( retail loss prevention ) - but you can completely ignore it ( there will be 5/6 letters overall ) - see

          The ban only seems to be for 3 months, so probably not too much of a hardship to just go elsewhere for that time. The notice is standard to cover them for DPA and your data will be destroyed after that time ( by the shopping centre - Primark will pass your data to RLP who I believe keep it for 12 months.

            Thank you for getting back to my picture sorry not replied yes I’m staying away from shopping centre for them 3 months but was wondering about primark as he only said verbally and by no letter so wondering how that works if I need to go in there after the 3 months.*
            Plus it will be 4 weeks tomorrow and I’ve still had no letter x x*
