I’m a first time claimant and made a massive error. I received notice in October of a court hearing date in feb and proceeded to follow the instructions carefully to submit evidence to the court and defendant. I’ve done everything as instructed in this whole process and I’ve tried to ensure that I don’t mess up. However I completely forgot the fact that I was supposed to pay the court fee in Jan, I have to hold my hands up as it’s totally my responsibility and in hindsight I should have paid it back in October I don’t know why I didn’t. I just mis-understood the document and made the assumption that I would get another letter to remind me. Anyway today I received a letter to say the case is struck out because of my failure to pay the court fee. I’m so angry at myself as I felt I did everything right and just made a really really stupid mistake in forgetting this important detail. I’d like to know if there is any possible change of me appealing to the court and reviving this case. The defendant really caused me a lot of personal stress and financial cost after doing some really bad work on my property in 2018. I really want to revive this so that a judge can look at this and make a decision on who is right or wrong. I only have myself to blame but I’ve never been through this process and it would have been great if the court offered up reminders to inexperience people going through this daunting process. I’d appreciate any honest advice from the good folk on here. Thanks.
