Good morning all. I recently returned my audi using the Voluntary Termination platform. I was very careful to document the condition of the car etc etc. However, I have received their invoice and discovered that they are levying a charge for excess mileage of £1949.95 incl of VAT. This came as quite a shock as I expected a small excess charge, but then discovered that my PCP contract had an annual mileage of 10k miles not 15k miles as I had stated when buying the car. Yes, completely my fault for not checking the contract but in my defence, I had assumed that if you tell the salesman it's 15k miles, thats what you get. Every insurance policy that I have taken out over the past years is for an annual mileage of 15k miles. What can I do? I am led to believe that excess mileage can not be charged. Please help.

Make a formal complaint with a view to taking it to the Financial Ombudsman. That you have had insurance policies stating 15k annual mileage should be seen as confirming that you asked for the PCP to also be based on 15k annual mileage and the 10k mileage was an error or mistake by the lender - there will be some liability on you as the 10k mileage limit is stated in the agreement that you signed. Of course, also look into whether mileage excess charges are enforceable at all first - as Luxardo asks - what does it say in your agreement exactly ?#staysafestayhome

Hi all, thanks for coming back to me.
The contract states. you are liable to pay us the excess mileage charge as stated on page 1. That liability will accrue with each mile covered by the vehicle in excess of those mileages. You must discharge that liability by paying us the charge on demand. The charge is 0.09p per mile.
I will make a formal complaint and see how I get on. Thanks for your help so far.
