  • Identity theft

I recently found out I have a CCJ against my name for some 10-12 years ago concerning a amount of £7000+ from HSBC bank, I have been querying this debt for 5 years as have no ideal about it. I was bullied in to paying 5 a month just to keep the bailiff from taking my belongings but still insisted that I know nothing about the debt and contacted citizens advice who advised to stop paying and report as identity theft which I did, I even had a visit from the police about is I’m a disabled older lady in a lifeline accommodation on state benefits. I contacted the hsbc bank but all they could say was they only keep 6 years back dated information but what to do now as the company of solicitors now dealing with this issue advised me to get legal advice as it’s definitely identity theft as have been in receipt of state benefits of some kind for the last 30 years and bank with the Halifax for 40 years and couldn’t even get a £50 overdraft. When my father died he left me some money which was paid in to a hsbc bank opened by the legal rep from my fathers will but only used the account until I spent the money and never used it after and had never given it a thought until I had a visit from a bailiff who wouldn’t believe I knew nothing about this. Can you help

    Hi there,

Is the CCJ held by HSBC ?
If it was obtained over 6 years before you had the pleasure of meeting a bailiff then they should have had to apply for permission to the court before starting enforcement and will have fallen off the judgment register. However you say you have been querying it for 5 years ? Have you been paying this £5 a month for 5 years too ?

Send a Subject Access request letter ( https://legalbeagles.info/library/gu...ccess-request/)to hsbc asking for everything they hold about you.
send Data Protection Officer, contact us at P.O. Box 6201, Coventry CV3 9HW addressed ‘for the attention of the DPO’.

Despite what they say they must hold some data to have applied for a warrant and to have sent bailiffs on the back of such an old judgment. Getting that might help start getting this sorted out.

Have HSBC said this is linked to the account where your fathers money was put or is that simply the only thing you can think of that you've had to do with hsbc ?
