    Hi I hope someone can help me out here. I have a charge registered against my property from a mortgage loan broker called the mortgage point that has since gone bust and has no forwarding address. How would I go about having this charge removed from my land registry? The charge relates to them selling insurance back in 2006 as a condition of sorting mortgage out and I dropped the insurance meaning the company didn't get their commission so the applied for a charge on my property. I was in the process of complaining many years ago when they went bust and since then I have had no way of sorting this out. Any help guys would be much appreciated so we can look at selling the property next year.

    So you took out insurance when making your mortgage application through a broker, but cancelled the insurance after the mortgage had gone through. The mortgage broker ( The Mortgage Point ) then took you to court for lost commission and obtained a CCJ then a charge over your home? How much was this for? If it was a court claim then did you defend/go to hearing etc or did it go to a default judgment?

    Do you have the actual text from the land registry regarding the charge?

    There are a few companies called The Mortgage Point - one is in liquidation - https://beta.companieshouse.gov.uk/company/01957012 - do you have more details - company number etc from your original documents etc to check which company it was?

    You can apply to the land registry to have the charge/restriction removed however the LR would write to the charge holder to ask if they have any interest in the charge - so if the company is still in existence, still going through liquidation, they may respond to say they want to keep the charge, so it is best to find out all the facts first.
