  • Lowell threatens prison

    Hi...I took a credit card out in approx 2010. After a couple of years I struggled to keep up with the repayments and so stopped paying. My last payment was taken from my bank on 2 December 2013. Since then my debt was sold to Lowell who started chasing me and threatening me with all sorts. I’ve found out that they got a ccj against me dated 13 February 2017. I have come home yesterday to find a letter saying that they have papers for me to collect at the courts and therefore must contact them by 9/12/19 or face imprisonment for contempt of court. I have tried to do some research but the internet says so many different things. one of my friends says my debt should be statute barred as I didn’t make payments for 6 years, I’ve never corresponded with anyone about this debt and that Lowell isn’t the lender so they shouldn’t have took me to court for a ccj. Please could I have some help with what to do. should I contact the court and make arrangements to pay Lowell or is my debt no longer enforceable. thanks in advance for any help*

    Does the letter say it is for statement of means / attachment of earnings ? Have you received anything prior to this letter ? You will need to contact them or the court.

    As the judgment was obtained within 6 years from default it won't be statute barred.
