  • Sainsbury Ban

    I raised a civil dispute with Sainsbury executive office on 11 November, after poor service from their so called care-line.
    The reason was I was exercising my consumer rights about a defective item of clothing.
    I was told I had to send a receipt, which I could not find, I repeatedly looked and asked them to resolve it another way, by providing prepaid label to return it or to move the issue forward.
    Contacted trading standards who advised a receipt was not needed as label would suffice and I was within my rights a# they allow a year to return faulty items.
    I decided to complain about error in advice and to escalate the matter to Mike Coupe.
    My emails came back undelivered with the message my email address had been blacklisted!
    I also had since found the ticket from clothing with details on it and found transaction too.
    I phoned the store as exec office refused to take my call or accept my purchase receipt, I-was informed I would be refunded by store.
    Exec office kept telling me there was a letter on the way but refused to tell me what I had done wrong, this affected my health and gave me hypertension, which I never suffered with before.
    I received the letter today from security and loss team, which banned me from store and police action if I entered, why would I?
    It also accuses me of being involved in an incident on 3010/2019.
    I have never been involved in any such incident that would warrant such a ban and. Was nowhere near Sainsbury store or online on that date.
    It also mentions debt recovery which again is alarmist and unfounded as I always pay and get receipt,
    I have phoned them and read the letter to them but they could not understand it and said she would ask the legal team an get back to me.
    It tells me to respond to Head office address if I disputed it so I phoned to be put through to security team and exec team terminated my call as they say no contact is to be made and refused to give me the email address to dispute decision or phone number of sender.
    Citizens advice just said it is private property so they can Ban as they like.
    That is acceptable but I want and am entitled to a full and frank explanation and they refuse to give me one, and mad3 it very difficult to do ADR as they false advertise CEDR as an ADR scheme they belong to but CEDR say they are always telling them to remove this false misleading information.
    Please can a solicitor or someone advise if this is a defamation case and can I get legal help.?
    can I take legal action against Sainsbury because of this?
    I am extremely worried at the misleading , threatening content of the letter.

      Citizens Advice are correct, Sainsbury's are entitled to ban anyone from their stores.

      It sounds like the ban and subsequent letters might have arisen from a misunderstanding ( they sound like the standard shoplifting incident letters ). You had no contact with Sainsbury's on the 30th October at all ( not in store or by email / phone / online )

      I'd make a formal complaint in writing to Sainsburys Head Office.

      So basically you purchased an item of clothing from Sainsbury's ( presumably own label ( Tu ?) so it really could only have been purchased from them ) - it was defective so you went in to a store ?? to return it.They refused as you didn't have a receipt.

      You have since found the receipt - I'm not sure from your post if you have since sent a copy of that or taken it in to a store with the item ? If so what happened ?

        They have banned me but a manager has offered to refund it and told me to come to store with it.
        I told her of ban but she said she had not heard anything and was quite shocked.
        I have found the Nectar point transaction and will take it in as screenshot, but she did not insist.
        on 30 October I did ring Caroline several times, and was told several misleading things, by various advisers. take it to store, or send pictures to Tu, which I did but Tu told me it was wrong advice and Caroline should not be telling me that as it was not bought online.
        this was very frustrating and may have got heated is the only thing I can think, they did state no abuse or threatening behaviour is tolerated but I try to be patient.
        I am not a threatening abusive person or would have been banned 20 years ago or since I have shopped there.
        done a lot of litigation and have had to practice patience and calm, not easy, over the years.
        This is vicarious liability on their part for giving contradictory advice.
        Emails were blacklisted so could not send copy of transaction.
        The only person who has made a loss is me with the coat so far.

          Yes, I guess your frustrations at the incorrect advice being given by Caroline may have been flagged as abusive behaviour.

          I think a formal SAR is in order to see what went on for you to end up with the 'incident' letter. Then you can make a complaint from there about their handling of this.

            I did email them to dispute the imposition but they have not replied.
            Whilst I do not care to shop there anymore due to their terrible policies re discrimination against disabled people and breaching their data, also quality pricing, but the way they have misrepresented me over this, I am most upset and affronted so that is it as far as shopping is concerned.
            Much better quality to be had out there.their loss.

              It's a formal request for copies of all data held about you by Sainsburys. Example letter Subject Access Request Letter.

                  no reply yet to my SAR Request, can I take legal action against Sainsbury? They seem to have a very closed culture, ie no ADR membership with schemes, They are ignoring every email about incident and what evidence they have to back it up, and my data which they threaten to breach, surely they are answerable to someone.

                    The dispute dept resolved it eventually. They are very anal and expect you to grovel to be let back. I was being defensive.
