  • Parking charge

    Hi,
    I received a Parking Charge Notice for going over on the parking time limit at a retail park. It doesn’t say how long I’ve gone over by and the charge is £85 or £50 if paid within 14 days!

    The incident occurred on the 5th Nov, the Notice is dated 14th Nov but I didn’t receive it until the 20th Nov.

    What should I do?

    Could you post up the PCN so that it can be read. Yse imgur and link to it.

    I think you need to do more redacting.

    To hold the keeper liable they have to deliver it within 14 days. It is assumed to be 2 working days after issue but could be a difficult to argue.

        Did you read the comment about more redacting? Take down, redact and repost. Remove PCN number, name and address etc. so that the identity cannot be inferred.

        That PCN misses so many POFA requirements but this should do in the first instance:


        Dear Sirs,

        I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

        You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

        There is no legal requirement to name the driver at the time and I will not be doing so.

        I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

        Send first class mail with a free certificate of posting from a post office.

        They will probably reject but this, together with all the other fails, just result in a successful POPLA appeal, but only if you haven't shot yourself in both feet by hinting at the driver.
