  • Application to set aside judgement

    Hello 1 hour hearing by defendant to set aside judgement as they claim i did not particularize claim.

    Do i have to attend 1 hour hearing or can i write in to london court with reason i think should not be set aside, i should have instructed sherriff high court in hindsight. Hearing in two weeks time.

    Any advice i had judgement and this large company are playing dirty over £1,000 they owe me, claiming they moved premises, though they have not, they say did not receive the claim, though they rang me up threatening i lost the equipment etc.

    I took them to employment tribunal on another matter and won but not paid me as they appealed it twice and now third time

    You obtained Judgment in default due to the Defendant not acknowledging or defending the claim ?Â*

    They are applying to set aside judgment claiming lack of particulars and that they didn't receive the original claim due to a change of address ?Â*

    You're also at employment tribunal with the same company but on a matter unrelated to the county court claim ?Â*
