  • County court claim over ibis parking for 19 minutes! £260

    Hi guys
    I need some help please!

    I have been receiving letters from civil enforcement ltd since 26/12/2018 where my vehicle was in the ibis car park for 19 minutes due to my son getting sick (it was just off the motor way) I have ignored every letter. The last latter I got was 2 weeks ago with a reduce rate of £75.00 if I paid in 14 days ... today I received a claim form from county court business centre for a total of £246.40!!

    I need advice ASAP

    So acknowledge the claim NOW but put nothing in the defence, nothing. This gives you 33 days from date of issue to get your deence to the court.

        I’m really worried about getting a ccj.... what happens if I put a defence in and loose?

          The documents that you received from CEL.

          You need those documents to be able to at least build a defence.

          If you haven't got them then SAR to CEL and a letter to the solicitor requesting, in order to narrow the issues between you as expected by the courts, copies of all the documents that they intend to use in court. As they must have these documents to hand in order to raise the claim then you expect them by return and in any case within 7 days.

          IF you lose then IF you don't pay within a month THEN, and only then, will you get a CCJ recorded against you.

            I have completed the acknowledgement of service page but I am unsure which box to tick:
            1- I intend to defend all of this claim
            2-I intend to defend part of this claim
            3- I intend to contest jurisdiction
            ???​​​​​?

              I have no documents but one letter I didn’t throw away from a debt collector... what is a SAR?

                  Just "1- I intend to defend all of this claim"

                  Don't put anything further in - you're just acknowledging for now - to give you the full 33 days to file your defence.

                    It is a request for all data held by the company relating to you as an individual which they must provide copies of and request within 30 days.
