  • Car lease

Hello, this is my first post!

I’ve had a car on lease for 3 years. I have now purchased the car, however have been invoiced for the excess mileage....do I have to pay this? What are my legal rights? consumer act ?

Did you purchase the car by paying off the full amount payable under the agreement?

If so, whether you did no miles or 120,000 miles makes no odds to the lease company - if your contracted mileage was say 10k a year and the final purchase price was based on that mileage assumption, then it is only you that 'loses' out by buying a higher mileage car at the price of a lower mileage car.

However, that's probably the common sense way of looking at it so I will tag R0b for you - do you have the lease agreement and sale/purchase info ?

I phoned them up for a price to purchase the vehicle. They sent me an invoice for the amount payable to them.

You shouldn't be paying for the excess mileage because you now own the vehicle.

Who's the finance company on this? I would be looking at making a complaint because the excess mileage should only kick in if the car is returned since it's purpose is to manage the depreciation in the car's value i.e. the loss to the finance company.
