  • BW Legal/PRAC Financial/Instant Cash Loans Ltd t/a Payday Express

    Hi everyone!

Ok so I sent off for my proof of signed documents to BWLegal on the 12th August, I have the proof of postage also from the post office. They cased my £1 cheque but I never received anything! I have been waiting patiently as I didn't really know what else to do then on the 20th September I received a notice of Proposed Fast Track to the Small Claims.

On the 26th September I received a letter from BWLegal saying that their client intends to persue the claim. I need to reply as soon as possible to the court but am stuck without the required paperwork from BWLegal.

    What should I do?

    Thanks in advance

Hi Lotty, I'll see if I can find previous posts on this, but just to check the situation you sent the CPR and CCA requests, submitted a defence to the court and have now received a Directions Questionnaire from the court? Is the Directions Questionnaire the N180 or N181 ?

    PRAC Financial LTD Claim form

    6th August 2019, 21:30:PM

    Received a claim? Yes/No: Yes
    Issue Date: 02/08/2019
Have you Acknowledged the Claim?: In the middle of MCOL form
Total Amount Claimed : ( approximately please do NOT use EXACT figure given on the claim form, round up to next £100 or £1000) £500
    Claimant’s Name: PRAC Financial Ltd
    Solicitors Firm: BW Legal
    Original Creditor: Pass?
Original Debt (eg. Credit card/Loan/Overdraft) : It says Payday Express
Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ): It states that I have been issued a default notice
Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): 2013?
List any letters you have sent (eg: CCA/ CPR ): I have not sent anything yet.
Any Other Information or Background Details:

I have never even heard of anything or this company before. I searched my credit file and something appeared in 2013 had 2 greens and then unpaid and then a settled. I have absolutely no idea what this is for and never heard of the companies!? I have started the MCOL as I wish to defend but I do not know where to start. For instance, I am on the Defence Particulars page and do not know what to write.

Any help or advice would be really appreciated! Thanks in advance!

I am also having this issue too! I have just sent a letter today for a signed credit agreement! They have put too much on the original debt too! (this is not including the extortionate intrest) So glad I have found this tonight as I was feeling very sick thinking about it all!
Original creditor could have been any of a number of trading names under the Instant Cash Loans or Payday Express 'brand', possibly The Money Shop … have they not given any indication in their particulars of claim ( instant cash loans t/as payday express ?)

This was a payday loan you think that you took out in 2013 ? Or have you never had a payday loan and just found the info on your credit file ?

What did you enter as your defence?
