    Oh goodness, sadly yes I'd ignore until/unless they send a formal pre-action letter. However in the background you can be gathering information - do you still have any documentation relating to the reposession ? Were you aware of a shortfall at all at the time ?

    Once /if a more formal approach is made ( a letter of claim etc ) then I'd get a Subject Access Request to BOS - I wouldn't do it now as they will communicate and realise you have received the letters. It is unlikely, but if you keep quiet they may just go away and you'll get past the 12 year point. So I'd hang fire on taking any action for now.

    Do you own a property now?

    this is the MCOB - they do have the 12 years by the limitations act however it would be a breach of FCA rules to have not informed you of the shortfall before now. That would mean a complaint through the financial Ombudsman however again I would wait until a more formal approach is made. The SAR would show what was done at the time in 2008.

      Thanks for the post. No I don’t have any information on it, it was a long time ago. When I lost the property I moved and lived with friends at various addresses for a few years (as obviously had my house taken away and had to get myself sorted financially again with no credit record)

      therefore i I never even knew what the property had been sold for and didn’t even know if there is/was a shortfall. So the first I’ve heard about this is this week (11 years later!)

      ill hold fire fire on any action, as suggested, to see what action they take.

      Even though I lived at friends for the first few years, I’ve been back on electoral roll and with credit for the last seven/eight years or so, so it’s not like they could use an excuse that I’d disappeared off the face of the planet for 11 years, so I’m hoping if they do pursue the MCOB would be solution I would need.
