we signed up for Direct Access Leisure whilst on holiday in Malta in May 2019 but notified the company within 14 days that we wished to withdraw. Our bank card expired before the first payment and at no time were we requested new details. We haven’t paid the monthly amount as we have notified them several times that they acted illegally by not offering 14 days cooling offend by taking a deposit before signing the contract. We are now being threatened with debt collection. In the contract we were told we would get a welcome pack with membership card etc. This has never been received either. Are we right in believing that Direct Access is in breach of contract and therefore it’s null and void?
