  • Asset Claims Attachment of earnings order

Hi, My boyfriend has received a N271 (notice of transfer proceedings) and an N55 for a debt of £1,151.49 and he has absolutely no idea where it’s from. It’s also the first we have heard about this. The letter was sent to his fathers address (we moved in together 7 weeks ago) and was meant to be replied to with the ingoing /outgoing form within 8 days and was sent out on 29/07. The fact that we have not received anything up until this attachment letter are we meant to pay. Also will the delay in replaying cause us further issue? Finally the claimant details state Asset collections & investigations but it says I have to pay TM Legal, why are we not to pay Asset? Any help would be really appreciated. I’m in an IVA and have no knowledge when it comes to money etc, we’re both trying to clear all debts but keep having letters pop up and 2 of mine have been found to not be true debts of mine and don’t want to pay over a thousand pound if it isn’t warranted.

Is there a CCJ reference on the form ? You need to contact the court with the claim number and ask them if they can email the claim details - tell them you've just received the n55 and do not know anything of any judgment.

He should also check the judgment register and his credit file for ccjs.

Also if he can check email email addresses he might have used in the past when taking our payday loans etc ( generally that's what Asset deal with - Mr Lender etc) as TM Legal normally sent a stack of threatening emails once a CCJ is obtained. If the judgment is in Assets name then you would pay Asset.

Then he will need to consider whether to apply to set aside the judgment and suspend enforcement or apply to pay by instalments.
