  • Link Financial Old Debt Scam

    My husband has had cancer since 2009 so had old debts since then. We got 2016 a letter from Link Financial and didn't know what the debt was so I asked for explanation in writing, no phone calls. Said it was for the Co op bank so I asked, loan or card. They didn't know. I insisted on proper papers and we got one confirmed it was the credit card we had paid off in 2004.

    So why are they asking for money? They couldn't provide anything else, decided to write what it was off and closed the file, not taking any more action.

    2018 wrote again about the same thing. By the way we haven't had any contact with the Co op since 2009 when the loan was consolidated into another loan and paid off on a second mortgage. So we are confused as we don't believe we actually owe anything. The co op just ignored any requests for information. 2018 I referred back to Link proved the loan and credit card paid and card written off according to their own files. I referred to their letters of 2016.

    They then said there was a charge on the house for the account. I asked them for details. Four weeks later they showed a request for a charges order 2003 before the credit card was paid off but it was refused. I asked them for the original documents. They said they would refer the case back to the Co Op and ask them to write to us with any documents. We have heard nothing since.

    Today another letter from Link for same thing I guess ad no details of who or what it is for but it again says there is a charging order.

    My husband is undergoing more treatment and we can do without this nonsense again. I suspect it refers to the same order for the card which was then paid off in 2004. I feel as if I am going around in circles. How do I get rid of these clowns?

    If they have a charging order then it is quite serious, as they can apply for an order for sale, there is no guarantee they would get it but it is a pain that you could well do without it seems.

    Sadly, there is no way to get rid of Link, they are like all other DCAs im afraid, dodged determined and will chase anything if they think theres a sniff they will get some money, ive faced them many times and beat them in Harrison v Link and Link v Opie to name just two cases. It sounds as if you have some grounds to challenge them, but also need to take action quick to establish if they have a charging order on the house as if they do it will need setting aside asap and an application will need to be lodged in Court asap

      Hi, I am now posting under Banditqueen as have registered. Thanks for your kind advice. I will give you an email when I find out more.

      The point is though, they don't have a charging order as one was never made. That's what I found out last year when I demanded evidence.

      They had none to provide. An application was made in 2003 but never granted as the debt was consolidated and then paid off. We established this again last year.

      The next thing was they admitted they had no documentation and were asking the original lender, the Co op to send information to us directly. It appears the Co op don't want to get involved as no information came.

      How can I follow up? Will information exist after all this time? How can I find out for certain? Many thanks. Our last contact with Co op was 2008 to close the account down. Nothing since then until this lot in 2016 and at that time they could find nothing but the name of the lender and said they were taking no more action and closed the case. I have the letters from 2008 and 2016 and last year. I probably have something from 2003 as well.

        Have you checked with the land registry that no charges registered against your property? https://www.gov.uk/search-property-i...-land-registry
        I'd do that to be sure then make a formal complaint if appropriate.

            If they applied for a charge with court and it was denied they may have an interim order on there which will want removing. But have a look and let us know, then we can write to Link and tell them to go away.

                  Hi went on the Land Registry website. There are dozens of different types of documents. I don't know where to search. I asked them and just got a long list of prices in excess of £35 plus vat for copies of this that and the other. No information on what documents to look at myself. Most unhelpful people ever. So what now? I am on one benefit and my husband a pension. I don't have any money to waste on information on my own property. You used to pay £5.00 and fill in a form. Now you have to cough up £35.00 before you even know where to look. Link want the information, let them pay for it. I am done, looking for their scam.
