    Hello,
    My wife have received court claim and we consider to defend it.
    We have parked in 2015 on car park which was not properly equipped - there was no light and we have not seen neither parking machine nor notice board. One of the notice board was damaged and I have photo of it, which I made in 2016. We could have parked 50 m away on high street if we wouldn't know that parking is chargeable. We think this was parking scam, which makes money by misleading people and collecting penalties. Today car park doesn't exist and is free of charge!
    This is BW legal is third debt recovery company dealing with this and they have taken this case to court.
    The question is - do we have a chance to win this case in the court based on the fact that there was no light on the car park? We genuinely didn't see boards and the machine. Also the fact that car park doesn't exist show that it was short term scam.
    Any help/advice will be much appreciated.

    BWL have been instructed as legal representatives, not merely debt collectors.

    & it would seem you have a reasonable defence to the allegation.

      Thank you! Have done acknowledgement. Now have to do defence. My main reasons would be not clear signs and no lighting. Is there any regulations regarding lighting on parking spaces? In my case paying machine was in the deep end and it was not possible to see it...
