  • Setting aside a CCJ

Hi Legal Beagles.... I am trying to fill out an N244 to have a county court judgement set aside.

Two years ago i went to a PPI company, and asked them to get my PPI back. I realised I could do this independently, so i rang the ppi company and told them i didn't want to proceed. This was all in the midst of a terrible addiction, that led me to putting a rope around my neck and killing myself. Temporarily...!

The next thing i knew i had bailiffs at the door asking for £700 + costs. I rang the PPI company who were very accommodating and accepted my 'side' and put a stop on the proceedings, and i heard nothing more.....Until last week, when i discovered to my horror i had a CCJ.

I rang the PPI company who said that the debt had been marked as satisfied, but it doesnt say so on experian. ON further investigation, i discovered i could apply to have it set aside completely. i didnt even receive a letter informing me of the debt etc etc.

Im happy to pay the costs of applying the N244 to the courts, and i am confident the ppi company will not contest it.

Can anyone tell me how to complete the N244 satisfactorily?

    With best wishes,
    Jamie

Can you say who the ppi company are? ( bank smart ? )

To help at all with the set aside - we need to know whether you received the original claim form and whether you did anything with it, or if the first you knew of a court claim was when the bailiff turned up at your door. If you hadn't received the claim form, do you know why not? had you moved house ? or was it simply when you were struggling with your health issues and unable to deal with anything ?

Also can you confirm if I understand correctly that you haven't paid anything to the PPI company - they simply marked the judgment as satisfied after you informed them of your health issues?

Do you know how long after signing up with the PPI company you cancelled with them?

      Hi Amethyst.
I haven't paid anything to the PPI company, MyClaimSolved. I rang them to say i couldnt cope, and explained my circs, and they obviously marked it as satisfied... but in any case this hasnt made it to Experian...

I didn't actually receive any court order or anything- i only met the guy from the sheriffs office. Ive attached the correspondence below...

Thanks all, i really appreciate your help

If they marked it as satisfied it would take a month to show up on the register and wouldn't show on your credit file until the next monthly update after.

I have redacted your personal details of your documents for you.

Can you confirm whether you did receive the original claim?

N244 - it will cost £255 - there is an example of the Documents at the bottom of this page…https://legalbeagles.info/library/ho...-judgment-ccj/

You need to complete the N244 and attach a witness statement and draft a defence to the claim. You will need to explain why you didn't respond to your original court claim… So either that you moved house and it went to an old address or, of course, that you were suffering from severe health issues at the time.

You should probably also do a subject access request to. Help with any defence you might need to the court claim. https://legalbeagles.info/library/gu...ccess-request/ to myclaimsolved
