    Good evening,

    I am not sure where I should be posting this so I would be most grateful if you could point me in the right direction if possible please?

    I'm here on behalf of my mum. She has a sum of money owed to a ppi company, she received court paperwork from a well know company, she defended the claim simply because the ppi company did not provide her with the service that they sold her. They simply sent 1 email and then she spent months liaising directly with the mortgage company as well as supplying all of the required documents in order for her claim to be successful.
    The debt company asked her to withdraw and admit to owing along with sending her a copy of the document that she signed, it has never been disputed that she signed the document.
    They have now emailed a copy of the N180 that they have filled in however my mum hasn't received an N180?
    I tried phoning various debt charities to take advice and one piece of advice is to enter into a DRO. My mum is happy to do this because she will never ever be in a position to pay the amount that they are asking and feels this is the best way forward. I guess my questioquestishojld my mum let the debt company the ppi company and the court know that she is in the process of applying for a DRO? Also, I have seen that N180 forms can be downloaded, should she do that and send it off?

    ps I dont know if it is relevant but this ppi claim 'debt'is the only one however it is a substantial amount hence the DRO

    Can you tell me the CMC and claimants name please ( pm if you prefer )

    Will need to see the claim particulars and the defence entered. If your mum hasn't had the Directions questionnaire n180 from the court then maybe give court a ring to check it hasnt gone astray.

    Is this a case of she signed up with a cmc, but ended up dealing with it all herself, got a payout and now the cmc are suing for their commission ?

    What happened to the Refund? Was it cash/cheque etc or did it come off the amounts owed to the mortgage company ?

    DRO seems extreme at the moment... let's at least look at the case and see if she has a defence to the amount being claimed. Then there's likely other options less drastic ( monthly installments etc ) if it's going to be set on she actually owes the money.

      Yes they are suing for £8000 worth of commission, they literally sent an email. The bank would not deal with them because they could not provide the required information for a successful claim. The bank required my dads death cert, marriage certs etc. The claim company were copied into it but as I said it was all directly through my mum.
      They text my mum on several occasions threatening bailiffs with a camera crew etc so completely through fear she offered a payment plan which was declined on numerous occasions via email by HYC ltd. The refund was paid to mum by cheque from the mortgage company/bank. I will have to get the claim form etc off of my mum tomorrow if that's ok?

      Unfortunately yes, she signed up to them and she doesnt dispute signing the paperwork. What shes saying is they totally miss sold her a service as they literally sent a one size fits all email and she has done the rest. Mum isn't very clued up with these types of things unfortunately .

        I'm just a bit concerned that the defence she has entered is very basic and it is what it is literally she has explained that they didn't give her the service they want paying for.
        As it stands my mums financial situation is very very bad, she is on my late father's pension and a small pension from her old job. She doesn't get benefits and isn't entitled to any at all. The money is not there to pay them and neither does she have 8k worth of goods for them to take.
