  • Witnesses query - Small claims direction questionnaire N180

    We have received a copy of the claimants completed N180 form, of which item D3 "How many witnesses, including yourself, will give evidence on your behalf..." and they have entered "zero" . Could you please advise, for what reason would this be zero? Or, could this be a typo? It was completed by the claimants solicitor. Prior correspondence received from their solicitor indicated that the claimant plus their legal representative, would be present. We are defending the whole claim and, our completed N180 form included "2" being my hubby and I to give evidence. Many thanks.

    They may not intend to attend the hearing and have their side heard just on papers, or just send a representative, who isn't a witness as such. I wouldn't worry too much, these Directions Questionnaires are more for the court admin process for anything else. If you and your husband intend to attend and are both parties to the facts of the case you'll likely need to do a witness statement each - normally witness statements are ordered after the case has been sent over to the relevant local court.
