  • Money Claim Online Fee and additional trial fee?

    I had a hearing for a claim I made via Money Claim Online set for this Friday but today received a letter from the court saying the case had been struck out because the claimant (me) had not paid the trial fee of £115.

    When I filled in the form online for a claim of £1400 I paid £70 to Money Claim Online. Was I meant to then pay the additional trial fee, if so why are you charged twice?

    Now the case is struck out is there anything other than bringing a fresh case that I can do?

    The initial fee is just for starting the case. Often cases will be resolved without the need for a hearing and therefore no more to pay. As you have found out you have to pay a fee for the hearing

        Also, there was a counter claim, does that mean that would have been struck out at the same time?

          The counterclaim, with it's own fee, will still be active. Unless they haven't paid.

            You have to apply for relief from sanctions to set aside the strike order. You will need to have a good reason as to why the hearing fee wasn't paid. Details of the hearing fee due and when witness statements should be exchanged should have been on the notice of hearing date?

            Did you file a defence to the counterclaim?
            Have you exchanged witness statements ?
