  • Court claim

Lowell have sent a claim to my address for my grandson. He hasn't lived with us for 5 years. I wrote several times telling Lowell that he didn't live with us and that he was abroad in 2016 doing charitable work. I told them that I did not have a permanent forwarding address for my grandson. I told them I was 71 with only an old age pension and that their letters caused me great distress. They never responded, but have now sent a court summons. What do I do?

When you say he was abroad in 2016 - was that when Lowell are alleging he entered into the agreement which has led to the debt?

Did you receive a letter of claim with a reply form prior to receiving the court claim? ( is this a Northampton County Court Business Centre claim?)
and if you did, did you respond to it to say, basically, not at this address?

Do you have contact with your Grandson at all? is he aware of this debt / claim ? Presumably the court summons is addressed to him at your address, and not addressed to you, so other than pass it to your grandson or return it to the court as not at this address there isn't a great deal you can do, however if he gets a default judgment ( by not responding to the claim ) it could well affect your credit file if he is linked via 'financial associations' on your credit file, and of course, if they get a default judgment and decide to enforce you could end up having to deal with bailiffs so it is really in your interests to get your grandson to deal with it if at all possible.
