    Hi, I have recently filed a small claims form. The defendant has disputed my claims of negligence. I have completed a N180 form. However, is there a way of issuing more evidence to show that the defendant is lying in his statement? If so, when do I send this in?

    Later, once the case has been allocated you will be required to file a witness statement and evidence xx Normally two weeks before the hearing.

    Alternatively you can file a reply to defence but that should be submitted WITH the N180 - as it's small claims waiting till Witness Statements is fine.

    If the defendant has mentioned documents that you were not previously aware of you could request copies of documents mentioned in their statement of case under CPR 31.14 Or ask questions under part 18 so that's not really appropriate for a small claims case.

    Actually.... When you say 'negligence' is this a personal injury case?
