If the defendant in a small claims court is also the witness can he also ask questions of the plaintive. For example " the painter arrived as I went to lunch, and when I returned 60 minutes later he claimed to have painted the kitchen with three coats of emulsion ". This would seem to be an impossible task but would the defendant/witness be permitted to cross examine the plaintive on this matter??

If the defendant is Litigant in Person (representing themselves) then they may cross examine all witnesses. However, said LiP would be well advised to counter discrepancies in a witness' account by addressing them to the judge who in turn will expect an answer.COMPLETING AN N180 DIRECTIONS QUESTIONNAIRE (SMALL CLAIMS TRACK) GUIDE
