  • Arrow Global Charging Order

    My wife had an outstanding debt with a company called Arrow Global they obtained a county court judgement for you then proceeded to place a charging order on our jointly owned property.
    I was not in a position to dispute the charging order on my wife's debt as this could possibly jeopardise the sale of the property which had been on the market for 3 years. After all the charges had been paid there was a small shortfall that had to be made up be me. I am correct that on a charging order they can only take my wife's share of her equity to cover the debt? as currently I have paid half of it.
    Any help would be gratefully appreciated.

    Is the charge fully paid up now and the property sold ?

    If the original debt and judgment were only in your wifes name and she was joint owner of the property, then it would have been a restriction rather than a full charge. If you were ( or are ) joint beneficial tenants ( rather than tenants in common ) then you both own the whole property and don't have 'shares' of the equity, you both own it all.

      Yes the charge is fully paid up original debt was in my wife's name and she was the joint owner. It was a charging order by Arrow Global on the property. My question is can I claim my share of what I paid on her debt which amounts to £10,000 total debt was £20,000. If so can you recommend a solicitor who has had dealings in this type of case with Arrow Global? If they think I have a good case to reclaim my share.
