  • Tenant fee ban

    We are going through the process of renting a new property with a move in date 1 week before the tenant fee ban comes in. We have only paid a holding deposit so far and not signed the contract. The tenant fees they are charging us are more than I've ever paid. I've asked that they remove the charges completely as it is just 1 week before the ban comes in to force. Do I have any legs to stand on here? If I delayed the move in date by a week, would I be able to then have the fees removed? Thank you

    Unfortunately it's unlikely, when paying a holding deposit you usually have to agree to the agents terms, which by your post are based on the current rules and therefore no matter how long you delay the move in date you will be liable to pay the fees.

    The only way that wouldn't be the case is if you haven't agreed to any terms.

    That said, people don't tend to realise with renting how much room for negotiation there is and most don't even try to negotiate the monthly rent.

    I'd be inclined to start making noises that you may withdraw from the process and wait until June to find a property given the amount of money it'll mean you'll save, but then that's dependant on how quickly you have to move.
