  • Scaffolding erected on my property

    I’ve returned home from work this evening to find scaffolding erected on my property, I was aware he had planning permission for a dormer and side extension because I had make an objection to this, I have asked my neighbor to contact me ASAP, how do I stand legally? I don’t want his scaffolding on my property it’s also blocking access to my drain which I’m having an ongoing problem with. Should I contact the scaffold company directly? Any advice would be grateful received thanks Louise

      Assuming relations with your neighbour are at zero You could warn them they are trespassing and you require the scaffolding removed immediately

      You could also take action via the courts
      An injunction to remove it and then a claim for trespass (but you can only claim for your losses/damages)

      However you might be better off trying to negotiate a compromise along the lines they pay to locate scaffolding on your property, but clear access to your drain. Any damages are made good and scaffolding is dismantled on their side (you don't want it dropped on your ground from rooftop height!)
      After all they are your neighbours and you will still be living next door.
