  • Restriction on property

    what happens when a firm which no longer exists put a restriction on a a property that they built and sold. The owners were supposed to consult with the firm before undertaking certain work. Who would the owner contact now

    Is this a restriction in the register or a notice entered in the charges register or something else?

        OK, but what I was trying to ascertain was whether this is a RESTRICTION or a NOTICE.
        A restriction prevents transferring or relinquishing of that property to another
        A notice registers an interest affecting a property.

        Perhaps you could spell out the "restriction" you are concerned about.

          the problem is the height to which a hedge has grown. As the firm no longer exists who is responsible for enforcing this.

            It sounds like a covenant ? It doesn't mention maintenance, only erection/planting, so is the hedge on your land?

              So that would be a covenant protected by a notice on the register.

              Is this a hedge on your side of the boundary, or on the neighbouring land?

              If it is a neighbouring hedge which is adversely affecting your enjoyment of your property you can complain to the local council.
              They have the power to take action under Part 8 of the Anti-social Behaviour Act 2003
              But best to try and resolve any problems amicably.

              If it is your own hedge you are concerned about, I would disregard that covenant as it is impossible to gain permission from a non existent body
