  • TM Legal can they do this?

    Im urgently looking for advice before I call this company.
    So ive uploaded copies of correspondence by email to my junk folder from TM Legal Associates. Never once did I get a letter in the post.
    Anyway I dealt with the matter straight away from when I opened the first email. To cut a long story short I’ve been making regular monthly payments of £30. I have not missed a single payment. I am completely annoyed ( to put it politely) to have received two emails since 7/3/19 to say that although I have an existing arrangement they are going to apply for a CCJ anyway if I do not pay in full within 30 days. ???????
    Can they do this?
    On top of if they’ve also added a £22 charge between Thursday and Wednesday. I did not see these emails straight away as yet again they went to junk.
    Desperatley need to know how to approach this matter.

    Yes I know I’ve left my name and reference numbers on show... I’m not sure how to remove these pics and start again. That’s how stressed I am☹️

      Hey don't worry xxx I'll reply in morning properly and put your pics back up - but please don't be stressing .... have you had nothing through the post at all ? Have you moved house since you had whatever the original debt was ( Mr Lender maybe ? )

        Letters attached - there's £160 left owing and you're paying via continuous payment authority on your debit card ?

        They don't quote any claim number so I think to be absolutely sure I would call the northampton ccbc and ask them , with your name and ask them if there is a claim issued against you at an old address by Asset / TM legal - if there is ask if they can email you details and what the current status is, so you can acknowledge/defend etc, and if there isn't then, well they are now an SRA regulated firm and those letters are very misleading....

        So that's first thing to do

          Thanks I was going to call them today. Yes we moved in February last year. I put a claim through last summer for a few Payday loans and Yes you’re spot on one was Mr Lender. It was after that when I received emails via Junk ( I’m not sure if letters had gone to previous address) but it was a coincidence that they emails me after my claim??
          Thing is I’ve not disputed this debt and have made regular payments upto date. I just think it’s really shit that this bullying tactic is used. Also instead of my debt going down they then slap on a charge to issue me with a CCJ anyway.
          I’m baffled that they can honestly do this. We watch every penny as it is, pay our bills and do our best to get on. It’s just unfair.

            Okay give the court your address from last year so they can check the system .... the 'letters' do show your debt has been reducing and only has £160 left so seems ridiculous for them to have taken court action, IF they have.

            TM Legal have, in the past, made threats which have been, well, lies. Stating they are sending off forms for attachment of earnings and warrant of control when there is not even a judgment in the case ( as it happens the 'debtor' defended against the claim and won their case but TM Legal continued making threats ) I completely agree it is shit and if there is no claim issued then you will be making a formal complaint. If there is but no judgment then you can defend the case. If there is a judgment you want the date of judgment so we know what time you have to either pay it in full or apply to set aside the judgement.

            Let me know once you've spoken to the court and whatever the situation is there it can be sorted xxx

              Hi
              I managed to ring the court. As I had no court claim number the lady advised me to ring TM Legal /Asset and ask for a court claim number which I did.
              I spoke to a guy called Richard who took my details. I explained that I'd been in touch with the court and that they had advised me to obtain a reference number.
              Richard couldn't give me this information. He apologised and said that unfortunately these emails were sent in error and I was to ignore them. He confirmed my balance to be 163.77 (not £185 with the charge as per email!!) .
              I did let him know that the matter has completely stressed me out all evening and taken time way from 30 children (teaching assistant) to try and sort out within working hours.

                Good, that's a weight off your mind isn't it Presumably the court did have a look under your name and address details and couldn't see anything before they suggested calling TM Legal. Glad you're sorted and can concentrate on your teaching now xxx

                I think a complaint should be made though, as I don't believe it was a 'mistake' at all - they do this all the time to people ( there's a lot of threads on the forum). If no claim was issued, the email are blatant lies, not mistakes.

                This part of one of the emails says clearly that a claim has been issued, interest, court fee and solicitors costs have been added, and now they are applying for a judgment (in default presumaby) they intend to add a further £22 fee.

                They also cannot remove 'said judgment' by contacting the court. It is simply disgusting behaviour from a company who only recently were given an ABS licence by the SRA.
