Hello, county court claim recieved from Lowell/BT

    Hi again I’ve just recieved recieved a letter from Lowell they have sent me a directions questionnaire and a notice of change of solicitor, they state the same has been lodged at court, I’ve also had a letter from county court business centre to say my defence has been recieved, a copy will be served to the claimant, what are my next steps and what does the Lowell letter mean ?

      Thank you for all the help I’ve had so far with this matter, this site is such an amazing find, the person who runs it is dedicated and knows their stuff.....
      ive recieved a notice of proposed allocation to the small claims track, stating this claim is now defended, the case is suitable for allocation to the small claims track, I have a small claims directions questionnaire that needs to be returned by 8/4/19....can someone please explain what all this means to me and what I’m best to do now, thank you Vicki

          Okay this means your defence has been sent to the claimant and they have replied saying they wish to proceed. So now you both complete Directions Questionnaires (Directions Questionnaire ) and return the original to the court, sending a copy to each other.

          The case is then sent to YOUR local county court for 'directions'... which is usually a hearing date and instructions over when to supply any evidence, any specific documents required, exchange witness statements and when by the claimant needs to pay their hearing fee.

          We took out a BT broadband agreement in spring 2015, we had problems with the broadband and it never worked, after a couple of months of disputes with BT we did breach our contract and left to go with another provider.
          Did you make complaints at the time ? and who did you move to? Did they offer a 'switching' service ?

            Umm I’m sure we complained to BT I’ll do some digging and see if I can find anything, I’ll complete the questionnaire and return it, thanks once again for your sound advice Great work your doing x

              They didn’t offer a switching service, we complained to BT...Lowell have also sent me a letter stating they have agreed to mediation and are asking if I agree to mediation. If I do I need to put it on my directions questionnaire....would this be an advisable thing to do ? They have also asked if I’d like to settle the matter directly and if so to put forward an affordable settlement....please advise I’m returning my directions questionnaire today but not until I’ve had some advice from you wonderful people x

                I have a similar problem with a mobile phone provider.
                Lousy service, cancelled contract, years later Lowell/Lucas are chasing....obviously bought a 'delinquent debt'.
                The cancellation was done via phone as encouraged by the service provider.
                I've contacted them (service provider) & have been told that they only keep a record of phone convo's for a short while.
                It occurs to me that Lowell were not party to that call......so only I can say what occurred!

                  Thanks, I’m just completing this questionnaire....hearing venue ? Can that be a court in your home town ?? Witnesses -how many witnesses including yourself will give evidence ? Is that 1 as it’s just me, Lowell have put 0 on theirs

                    Yes, or one that is most convenient. (The court has the last say on venue, but usually they are pretty compliant with your request.)

                    If just you, then 1 witness.
                    Lowell are indicating that they will just submit paper evidence etc, so no actual physical presence.
                    But I have known cases where a Claimant's rep turns up anyway on the day.

                        I would almost always do so.
                        The courts like to see at least an attempt to negotiate/settle out of court.
                        & Small Claims mediation is free & often via phone.
