    Howard Cohen taking court action against what I believe is a statute barred debt how can they take me to court .?

    They issue a claim and if you don't dispute it they will obtain a default judgement.

    Suggest you post more details if you want advice, and if you have received proper court papers start by acknowledging the claim but do not enter a defence yet.

    The more knowledgeable will then be able to help

      You should do as des8 says above. These companies like to get default judgments; saves them the bother & expense of an actual court case/hearing.

      What kind of debt are you talking about? (Credit card, loan, mobile 'phone etc.)
      Much more info is needed.

        I requested when they had received the last payment against this account they where taking to court, they have responded with a completely fictitious date which maintains the position that the account is not statute barred. We know it is how do we deal with their lie . The solicitors did not reply it was Robinson Way who replied

          Evidence? Although they have the burden of proof, the bar is not particularly high, so your 'reverse burden' is advisable.

            The debt is credit card debt with barclaycard I have requested copies of credit card details ,full statement of account, copy of dated default notice , deed of assignment ,can remember significant date when I didn't pay anything against any bills like this my grand daughter was 3 months old she is now 8 years old but I can't prove this
