Ive just read the deed and it says the beneficiary and owner to register the restriction which I didnt realise. I suppose now that the ownership has changed is it too late to so anything anywhere? Think we likely need to see the Deed.
Also, a little background, you mention the deed gives you ownership over part of the land, was this passed to you through a Will, or was this part of a divorce settlement ? and why are you paying half the mortgage ? The person who was on the deed with you and who has joint ownership of that bit of land with you is the same person that has bought the entire property including that bit of land from the owner ? and have you discussed your ownership of said bit of land with them since you found out they have bought it/transferred ownership ?#staysafestayhome

Hi, no the person who originally signed the deed with us to transfer or gift this portion of land (the owner) is still alive. I am paying half the mortgage because of 'owning' this part of the land and because there were business debts that myself and the other person that this part of land 'belong's to had to pay so we remortgaged . Well he did as Im not on that mortgage. I received £10,000 and he had an extension built that he now lives in, and the whole complete property is in his name only and yes I have tried to discuss matters but I am getting fobbed off. It is quite complicated for me to explain, I have just deen there is an 'assignment of a beneificial interest held under trust of land' dated the same date. |This gives myself and the other person ( it is my brother) equal shares in the assigned property. I have my business on this part of land and pay half the mortgage as 'rent' for the half my brother owns. Was the mortgage secured against the original land that was later split by the 'deed' ?
Is this noted on the original deed for the complete land ?I have just deen there is an 'assignment of a beneificial interest held under trust of land' dated the same date

Hello, yes the mortgage is secured on the complete property, but the mortgage was taken out in 2012 and the deed was 2008. Was the actual original aim to split the land or to simply give you a share in the land as a beneficiary ?
