So I now have 4 days left to submit my defence.
I have drafted a defence and would very much appreciate a review of it.
Could you do that for me and should I post on here?

I have not heard anything regarding my draft defence. I need to have my defence sent off by Friday.
Is there any chance you could review it and pass back comment please.
          Many thanks

            Hi

I doubt that the Claimant is S R-S.
It is more likely to be VCS Ltd.....a seperate legal entity.
Use the name that is on the N1 claim form.

I'll have a look back through your thread.

At this stage we are only assuming they are not going via PoFA.

I'd put the 'PoFA non-compliant' stuff in, just in case...

Also, a line or two to distinguish case your case from the Supreme Court ParkingEye v Beavis one.
In the SC case there was a legitimate interest in enforcing the excessive (my word) parking charge in order to ensure that adequate parking spaces were available to members of the public who wished to use a commercial retail park.
That clearly is not the case with residential car parks.

9.1. The Protection of Freedom Act Schedule 4, 4(5) states .......

              I'll have another look through.
I'm going to be out for most of the day, but will check back later.

Have you posted a pic (suitably redacted) of the court claim form (N1)?

I'd sue Specsavers (if I could find them!)

Another thing I would put in is that it must be possible for the parking co to check with the hotels etc first. before issuing & aggressively pursuing a bone fide guest.
'Beavis' is not a silver bullet! (Despite what parking co's seem to think.)

Write your defence in Word or similar, properly numbered and paginated, adding a jpg of your signature. Save it as a PDF and send it as an email attachment to the court. Case number, case name and document type in the subject line

                        OK great. Thank you.
Any idea where I can find the right email address?
Doesn't seem to appear on the Claim form - just has the mailing address and tel no.

There might also be a dedicated email address......check the instructions sent with the court claim form.

Phone up the court and ask what their current email address is.
