  • Lowell- setting aside a CCJ by consent

    I found out on Sunday that I have a CCJ dating back to 2015 in anticipation to a mortgage application. I immediately contacted the Court on Monday and was given more information. I then got in touch with Lowell and paid the £710 over the phone. I have called several lawyers which have advised me to try and set the CCJ aside by consent- by drafting a consent order.

    I got in touch with Lowell again today to ask whether this is something they would agree with but they have informed that they don’t do this. They said they will nownonform the Court that payment has been made in full but if I wanted to set the CCJ aside I would have to go through the Court arena. Ian this correct? I spoke to two different people at their call centre who have said they have never heard.

    Can anyone advise if they have been able to set the CCJ aside directly with Lowell???

    Now you have settled the amount there is no reason for the court to set the judgement aside, you were taken to court for something you owed and it's been paid, thus the record (your credit file) is correct.

    Hindsight is a wonderful thing, but if you had applied to set aside before paying you might have been successful and been able to settle the matter by consent by paying in full with Lowell withdrawing.

      I suspect the only thing you can do now is make sure that your credit record is updated to reflect the fact that the judgment debt has been settled/CCJ satisfied.
      They say that a little knowledge is a dangerous thing. That being the case then I have enough to be lethal.
