Hi All I am new to this so here goes.We are considering selling our house and I checked yesterday by searching summary of title as we have our main mortgage and 2 other secured loans however one secured loan as I suspected has not had a charge against the property registered . Where do we stand .All I have is a copy of a fixed loan agreement it does say that the agreement is made on the security of a legal charge on the address but if they have not for some reason registered it does that mean we do not need to settle when we sell .I wont name the company at this stage but they were a lets say lower end of the market lender.

If it isn't secured on the property then you wouldn't have to settle it when you sell. Presumably you're paying it monthly in any case ? so that would just carry on. Have you got a copy of the agreement ?
