Harrassment from Restons....can they ultimately be sued for harrassment

  • Harrassment from Restons....can they ultimately be sued - Cabot

    Hi,

    my first post so please be patient Restons have two CCJs against me...one for £17k to Sainsburys ( via Cabot) ad one for £&K from M&S I have agreed payments of £1pcm for Sainsbury and had that confirmed in writing this morning. Earlier today Restons phoned me, having promised to phone yesterday, and despite my history and bank statements want more than £1 for the M&S account. They almost called me a liar in the process but stopped just short but are being obstructive, non hearing and aggressive about it....which isn't allowed! Ultimately I would like to sue them for harassment because they shouldn't be allowed to get away with half the stuff they do. What can I do to get the same token payment in place if they refuse to listen? I am also already paying 9 other creditors £1pcm as a token gesture and do i not have to treat them all the same?

    Also, am I right in assuming that all I have to do to prove harassment is that they are causing me distress, as per the law ? Will that work? Help,please

    Talk to Cabot directly about the judgment, outline your circumstances and explain to them what Restons have been doing and ask to make a complaint. Restons are acting FOR Cabot, on Cabot's instruction, so they should be able to instruct Restons to leave you alone.

    Contact Stepchange if you haven't already to get your IE sheet sorted out with the standard financial statement so that it is accepted that all you have is the £1 a month.

    Is the £1 ordered through the court or was the judgment forthwith and you made an offer directly ? If it is a forthwith order you can, once you have your IE sheet sorted out, apply to court ( forms N245 and EX160 ) for installments which are set, and any changes/enforcement later would have to be applied for through court.
