  • How to register a CCJ, when you have a court order

    Hello,

Hope someone can help me, quick synopsis:

I've evicted a tenant due to a number of reasons including rent arrears, I went through the S21 route, and was awarded by the courts a possession order as well as court fees. The tenant hasn't paid the court fees to me, I foolishly thought I had to go via the money claim route, but this was rejected by the county court judge stating that the order had already been given. I don't want the money (as the tenant will not pay or have means to pay) how do you register a CCJ against the tenant, I just can't figure out how you do it or what form I require & costs for it. Someone told me to contact the courts, but they don't have a telephone number and state they can not give legal advice.

You can enforce the costs award (bailiffs/ AoE etc) but it's not the same as a moneyclaim CCJ so wouldn't appear on the register. There would only be a CCJ registered if rent arrears / damages ( so a money claim ) etc had been ordered as well as the possession order.
