  • County Court Adjournment Procedure

    I need to adjourn a court hearing due to my partner having had a serious mental breakdown-Can someone please tell me what the procedure is to do this?

    What kind of hearing is it? ( civil , family , criminal etc )

    If you can get consent from the other parties and it is over 14 days before the hearing you can make an application to adjourn on form N244 and there's no fee payable. The application will need to include evidence of the health issues and seems likely you may need to obtain consent to act on your partners behalf.

      Thank you. Do I definitely need consent from the other party? also it is joint names we are both defendants-does this make a difference?

        It would make life simpler if you obtain consent from the other side but they may say no and that the case can proceed with just you if the claim is against you both jointly, as may the court.

        Is this a mortgage possession claim?

          If you look at Gordon Exalls blog Civil Litigation Brief, there was a case recently where the Court should have adjourned but didnt, so it may be worth taking a look at that blog , ill post a link shortly if i get a spare minute

              Update; I submitted the forms for an adjournment together with a medical certificate clearly detailing the breakdown and how my partner needed complete rest. TYhe court refused this application-which I think is a kick in the face for mental health issues-We had no choice but to attend the hearing but my partner was not really fit (at all) can I complain against the judge's decision?
