  • Unfair Court claim from Watch finder

    Hi everyone.

    about 2 years ago I sent a rolex watch which i was given as a gift into watchfinder to see if they would like to buy it. They did their checks and confirmed it was genuine and sent me payment of £2200.

    THEN about a month later they decided to turn round and say it was counterfiet and demanded the money back. By that time it was already spent. I argued the fact that their team of specialists had confirmed it was genuine and that i didn't in anyway say that it was or wasn't and that they were the experts and i was trusting their judgment.

    So back and forth this went on for some time until eventually it went to the small claims court. I again argued my case but they won and i was ordered to pay them the money back.

    Well since then i have moved house and the new owner got in touch explaining that the bailiffs have been looking for me. I contacted them and they are sending a N61 form to my current address.

    In my mind i think i shouldn't have to pay this but its getting far too stressful now and i don't know if there's anything i can do so that's why i'm here.

    PLEASE HELP.

    P.S Watchfinder still have the Rolex.

    Not really - you have been through court and defended the claim against you, and the claimant won the case. So sadly however unfair it feels the time for aguing that is passed. A judgment was awarded against you, which you haven't paid, and therefore they have taken it to enforcement. You are well out of time to appeal the decision ( 21 days from Judgment ).

    Your best bet is to sort out a payment arrangement with the Judgment Holder else you will have the enforcement agents at your door.

    Was anything included in the order about return of the watch ? ( did you ask for that ?)
