  • What are my hours

Hi I currently work as a kitchen porter my contract states that I'm contracted to work 20 hours Monday to Sunday but underneath there's a paragraph which states that the organisation cannot guarantee minimum or maximum number of hours does this mean imI on a 20 hour contract or a zero hour contract any help would be greatly appreciated

I have no legal experience at all I'm a vulnerable adult with autism I've been a loyal worker for almost 5 years and now that I've been offered a job elsewhere i'm being held hostage by a 1 month notice period that doesn't reflect the nature of the immediate start business
All i want to do is claw my way out of a very deep hilh and find some self respect as previously stated the fact that they have said that the organisation cannot guarantee minimum or maximum number of hours in my mind makes it a zero hour contract meaning I can leave without notice.
please if this is right or wrong i beg of you please let me know I can't take any more I'm at the end of my rope (metaphorically speaking)

Do you have a copy of your contract Craig ?

It would be best to see the actual terms with regards hours.

Have you been actually working 20 hours a week for the 5 years you have worked there ?

You're most interested in the terms as to notice period.

If the contract is silent on notice period then it would be the statutory notice period which, for 5 years continuous employment, would be four weeks ( one week for first two years then one week per additional year )

One month notice is quite standard.

Do do you have any holiday entitlement that you haven't used that you could use to shorten the length of time you have to work ?

When does your new employer want you to start ?

Mike has tagged Ula as she's good with employment law situations so hopefully she'll pop by later on.

Hi Craig 123 we can help you get through this but it would be really good to see a copy of your contract. In the meantime another important question is do you have the ability to accept or decline the work when you are offered it?
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
