    I am looking for information on how to take a local authority to court myself any information on this subject would be appreciated thanks

    What makes you believe the liability order is fake ?
    Has there been a council tax debt that's gone to a liability order that you wish to challenge ? Or is it actually a forged document ?

      There is no trace on court record's it is a fraudulent document lts not on headed paper I know a lot about cival law and in particular council tax which is what this is about I also have an email from the courts stating there was no council tax courts on the date in question I would like to take them to court myself

          A summons was sent by my local council after a lot of emails the council sent me a liability order not the courts its quite long winded the council have two attachments of earnings orders on my wages I the council run there own courts in relation to council tax the ministry of justice say all liability orders must be officialy recorded i have lots of evidence to go to court with I don't know the process to make a claim

            Just so you are aware Liability Orders are sometimes awarded several hundred at a time. It is usual for the council to produce the relevant paperwork.

              Thanks for your post yes I am aware the council do it in bulk and they run there own courts I have actually turned up to court with the council summons to be told I am not on any court record's a legal magistrates liabilty order should be on headed paper mine is not

                The Court should have a listing of all people summonsed on a particular day, they are not individual. A Liability Order does not need to be on headed Magistrates paper - as said previously it is allowed for the Council to produce the paperwork.

                    I have attended many council tax liability courts - (60-70, or more),

                    It's very common for the court to say 'we can't find an order' because the person hasn't checked the list they have and they can just fob the case off to the council - it should be borne in mind though that the court don't know anything other than what is on the liability order application and probably don't understand it to interpret it anyway. I have also had more than once case where the court said no hearing took place but I knew full well it did as I was there !

                    There is no current prescribed format for a liability order to be in, the actual liability order is the signed order from the court. After the court hearing the council don't have to provide you with anything to say the order has been granted, if they do tell you there is no prescribed format that it has to be given in. The original legislation had a suggested format for a liability order however this was removed in 2003.

                      7. The Commissioner also asked how an individual is notified of such a decision/liability order and what is issued. The Council said that the individual is issued with a demand notice, followed by a reminder notice. Thereafter a summons is sent to attend court, setting out the purpose, location, date, time and amount the Council will be applying for.
                      In post #5 you said that the Council served on you a summons to attend court. So did you attend court on the day set out in the summons or are you saying that you attended court on the date stipulated on the summons only to be told that you weren't listed?
